Wavekey is a marketplace and discovery platform. We do not grant any usage rights in the samples, packs, or other audio uploaded to the Service. Every upload's terms are set by its uploader. Read this page in full before you download anything you intend to use commercially.
1. Default position: no rights are granted
When you download a sample or pack from Wavekey, the download itself does not give you the right to release, sell, license, broadcast, sync, or otherwise commercially exploit the audio. The download simply delivers the file to your device. The rights to use it come from the uploader, on terms the uploader sets.
This applies equally to the free catalog and the paid marketplace. Paying for a pack on the marketplace transfers money to the seller. It does not, by itself, transfer commercial usage rights — those are determined by the seller's stated terms on the listing.
2. Where uploader terms live
Each pack and sample on Wavekey has a License Terms section. The uploader writes their own terms there at upload time. Typical things uploaders state include:
- What use is permitted (private practice only, non-commercial release, full commercial release, sync, etc.).
- Whether credit or producer-tag is required.
- Whether a percentage of master/publishing splits is required if the sample is used commercially.
- Whether further per-use clearance is needed (common for samples that interpolate existing works).
- How to reach the uploader to discuss extended terms.
If a listing's License Terms field is blank, no usage rights are granted by the download. You must message the uploader through Wavekey and agree on terms before any use beyond private listening on your own device.
3. Negotiation between uploader and downloader
Wavekey provides direct messaging so a downloader can reach an uploader to discuss specific use. Any agreement reached this way is a private contract between the two of you. Wavekey is not a party to it, does not enforce it, and is not responsible for breaches by either side. We recommend recording the terms in writing (the in-app message thread is sufficient evidence) and keeping them with your project files.
4. What Wavekey itself receives
By uploading, you grant Wavekey a non-exclusive, worldwide, no-fee licence to host, store, transcode, preview, and deliver your files to other users of the Service. This is the minimum we need to run the platform. It is not a licence we sublicense to downloaders, and it does not include the right to use your audio in our own marketing or commercial output beyond basic preview/playback inside the site.
5. Uploader warranties
When you upload audio you warrant that:
- You either own the audio outright or have the rights to distribute it on the terms you state.
- Your stated License Terms are accurate and that you will honour them if a downloader complies with them.
- The audio does not infringe any third party's copyright, trademark, publicity, or other right.
If those warranties turn out to be false and Wavekey or a downloader incurs damages as a result, the uploader is liable for those damages.
6. Restrictions that apply regardless of uploader terms
Some restrictions apply to everyone using Wavekey downloads, whatever an uploader writes:
- No raw redistribution. You may not re-upload, resell, or give away a Wavekey download on another platform as a sample or sample-library product unless the uploader has explicitly agreed in writing.
- No AI/ML training. Wavekey content may not be used to train, fine-tune, or condition any machine-learning model that generates audio or audio-derived data, without separate written permission from the uploader.
- No illegal or hateful use. You may not use the audio in content that is illegal, harassing, defamatory, sexually explicit involving minors, or promotes violence against protected groups.
7. If uploader terms are unclear or ambiguous
Read narrowly. Ambiguity in a stated set of terms is resolved against commercial use — i.e. if it's unclear whether a term permits a particular use, assume it does not, and ask the uploader. Don't release a record on a guess.
8. Term and termination
Any rights you receive from an uploader last as long as the uploader's stated terms say they do. If your Wavekey account is terminated for breaching the Terms of Service, Wavekey's separate hosting licence (Section 4 above) ends immediately. That termination does not, by itself, retroactively revoke rights you legitimately obtained from an uploader before the breach, except where the breach is the use itself.
9. Disclaimer
Wavekey does not verify uploader warranties before content goes live. We respond to DMCA takedowns after the fact. If you intend to use a downloaded sample in something commercial, do your own diligence: confirm the uploader's identity, confirm their stated terms in writing, and keep records.
