Welcome to Wavekey. By creating an account, browsing the catalog, downloading a sample, or selling on the marketplace, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
1. Who runs Wavekey
Wavekey (the “Service”) is operated from Ontario, Canada. In these Terms, “we”, “us” and “Wavekey” refer to the operator of the Service. “You” refers to the person or entity using the Service.
2. Eligibility
You must be at least 16 years old to create an account. By using the Service you confirm that the information you provide is accurate and that you have the right to enter into this agreement.
3. Accounts
You are responsible for keeping your password secret and for all activity that occurs under your account. Notify us at support@wavekey.co immediately if you suspect unauthorised access.
We may suspend or close any account that violates these Terms, the Acceptable Use rules in Section 7, or any applicable law.
4. Subscriptions and billing
Wavekey offers three tiers: Beginner (free), Novice ($5 USD per month) and Pro ($10 USD per month). Paid tiers renew automatically each month until cancelled. Cancel at any time from your account page — access continues until the end of the current billing period and no further charges are made.
Payments are processed by Stripe. We do not store your full card details. Pricing is subject to change with at least 30 days' notice; price changes do not apply to the current paid-up period.
5. Free catalog downloads
Beginner accounts may download up to 5 samples per UTC day from the free catalog. Subscribers (Novice and Pro) have no daily cap. Samples are licensed under the terms set out in the Sample License.
6. Marketplace (paid samples)
Subscribers may list packs for sale on the marketplace. Novice listings pay a 15% platform fee on each sale. Pro listings pay 0% platform fee. Stripe processing fees apply in either case and are deducted from the seller's payout.
By listing a pack, the seller warrants that they hold all necessary rights to the contained audio, that the audio does not infringe any third-party intellectual property, and that the license they grant buyers (see the Sample License) is one they have the authority to grant.
A buyer's purchase grants them the license described in the Sample License. Sales are final once the file is downloaded — see the Refund Policy for the exceptions.
7. Acceptable use
You agree not to use the Service to:
- upload, sell, or distribute audio you do not have the right to use;
- impersonate another producer, artist, or brand;
- scrape, mass-download, or republish the catalog;
- circumvent rate limits, paywalls, or marketplace fees;
- harass, threaten, or send unwanted bulk messages to other users;
- upload malware, illegal content, or anything depicting minors in a sexual context.
Violations result in content removal, account suspension, and (in serious cases) referral to law enforcement.
8. Intellectual property and uploader-set terms
You retain ownership of audio and content you upload. By uploading, you grant Wavekey a non-exclusive, worldwide, no-fee licence to host, display, transcode, stream, and distribute your content as necessary to operate the Service. This grant is to Wavekey alone, for the purpose of running the platform — it is not a licence to other users.
Wavekey grants no licence to downloaders. Each upload's usage terms are set by its uploader. When you download a sample or pack, the rights you receive — including whether you may use the audio in commercial work, whether credit is required, and whether further clearance is needed — are determined by the terms the uploader has stated on the listing, or by separate agreement between you and the uploader. If no terms are stated, you must contact the uploader before any use beyond private listening. See the Sample License page for the full framing.
The Wavekey name, logo, site design, code, and editorial copy are the property of the operator and may not be reused without permission.
9. Copyright and takedowns
If you believe content on Wavekey infringes your copyright, send a takedown notice to dmca@wavekey.co following the procedure on the DMCA page. Repeat infringers will have their accounts terminated.
10. Termination
You may delete your account at any time from your account page or by emailing support@wavekey.co. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to serve you would expose Wavekey to undue legal or financial risk.
11. Disclaimer and limitation of liability
The Service is provided “as is”, without warranties of any kind, express or implied. We do not guarantee uninterrupted availability, error-free operation, or that any sample will be suitable for your particular project.
To the maximum extent permitted by law, Wavekey's total liability arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) CAD $100.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email to your account address and posted at the top of this page at least 14 days before they take effect. Continuing to use the Service after the effective date constitutes acceptance of the new Terms.
13. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of Ontario unless required otherwise by a mandatory consumer-protection law of the country in which you reside.
